Kannanotto tiukentunutta turvapaikkapolitiikkaa vastaan.

 

 Olemme vakavasti huolissamme Suomen tämänhetkisestä maahanmuuttopolitiikasta ja maahanmuuttoviraston tekemistä valtaosin kielteisistä päätöksistä.

Maahanmuuttoon liittyvien lakimuutosten seurauksena ja maahanmuuttoviraston määriteltyä Afganistanin, Irakin ja Somalian turvallisiksi maiksi tilanne on muuttunut sietämättömäksi. Käännytyspäätöksiä tehtäessä on aina varmistettava henkilön mahdollisuus ihmisarvoiseen ja turvalliseen elämään kotimaassaan. Sisäistä pakoa käännytyksen perusteluksi pitäisi käyttää hyvin harkitusti ja harvoissa tapauksissa. Maahanmuuttovirasto kuitenkin käyttää sisäistä pakoa palautusautomaattina, vaikka kaikki maahanmuuttajan turvapaikan saannin ehdot täyttyisivät. Tätä emme hyväksy. 

Suomen perustuslain mukaan ihmiset ovat yhdenvertaisia lain edessä. Hallitus on kuitenkin vastoin perustuslakia kaventanut turvapaikanhakijoiden oikeusturvaa muihin maassa asuviin kansalaisiin nähden. 

Lakien muutoksella on kauaskantoiset seuraukset niin maahanmuuttajille kuin meille suomalaisillekin. Suomen perustuslain ja lakien taustalla ovat olleet vakiintuneet arvomme, joista nyt on luovuttu. Lakien ja menettelyjen muutokset vaikuttavat toimintatapoihimme ja asenteisiimme. Nyt on lähdetty tielle, jossa joillakin ihmisryhmillä on vähemmän oikeuksia kuin muilla.
Perhettä on tähän asti pidetty yhteiskunnan perusyksikkönä, jota pitää suojella. Perheen yhdistämisen mahdottomuus ja maahanmuuttoviraston päätökset, jossa osa perheestä käännytetään ja turvapaikka myönnetään vain joillekin perheenjäsenille, kertoo omaa surullista kieltään arvojen ja asenteiden muutoksesta. Paitsi perustuslakiamme rikotaan myös YK:n lapsen oikeuksien yleissopimusta, jonka mukaan lapselle ja perheelle on taattava asianmukainen suojelu ja humanitäärinen apu. 

 

Vetoamme päättäjiin, että tiukennettuja lakeja ja menettelyä muutetaan vastaamaan perustuslain henkeä ja kansainvälisiä sopimuksia.

 

Petition against current asylum policies in Finland  

We are seriously concerned about the current state of Finland's migration policy and the majority of negative asylum decisions given by the Migration Office.  

Since the changes in immigration legislation, and after the Migration Office has stated that Iraq, Afganistan and Somalia are safe countries, the situation has become intolerable. When making the decision of deportation it should always be ascertained that the person in question has a chance to lead a safe and decent life worthy of a human being in their country of origin. The possibility of internal escape in the country of origin should be used as a basis for deportation with due caution and only in select cases. However, the Migration Office uses the possibility of internal escape as an automaton of return even when all requirements for granting an asylum would otherwise be fulfilled in a person's case. This we cannot accept.  

According to the Constitution of Finland all people are equal in the face of law. Irrespective of this our current government has defied the constitution and restricted the legal protection of asylum seekers compared to other people living in Finland.  

This change in legislation has long-reaching consequences for immigrants and Finnish citizens alike. The bases of Finland's constitution and legislation have been our established values that have now been dismissed. The changes in laws and procedures influence our actions and attitudes. We have now moved onto a path which leads to some groups of people having less rights than others.  

Family has thus far been considered as the basic unit of society which needs all due protection. The practical impossibility of re-uniting refugee families and the Immigration Office's decisions to break up families by granting asylum to only some members but not to others, speak many a sad volume about the changes in these values and attitudes. Apart from our own constitution this is in violation of the United Nations Convention on the Rights of the Child (UNCRC) which states that a child and their family must be granted appropriate humanitarian aid and protection.  

We the signers petition the decision makers for the tightened laws and procedures to be changed to meet the spirit of the constitution and to meet the requirements of the relevant international accords.
