PÄIVITYS 01.08.2013 //// Korkein oikeus on evännyt 29.10.2012 jätetyn valituslupahakemuksen pikapäätöksellä 22.11.2012. Asian käsittely jatkuu Euroopan unionin tuomioistuimessa, jossa raidat toivottavasti saadaan vapaaksi. Jatkamme allekirjoituksien keräämistä adressiin niin kauan kuin asian käsittely kestää. Kiitos kaikille tuestanne! ////

Helsingin hovioikeuden tuomion (29.08.2012) mukaan suomalaisen Donna Moderna Oy:n pitää maksaa adidakselle noin 270 000 euroa ja hävittää noin 3 500 paria brasilialaisia West Coast kenkiä, joissa on neljä (4) tai useampia raitoja (katso kuvat).

adidaksen tavaramerkki on KOLME (3) samansuuntaista ja yhtä leveää mustaa raitaa. West Coast kengissä raidat ovat eri levyisiä ja suuntaisia suunnittelijoiden luomia yksityiskohtia, eivätkä minkään kengän tunnus. West Coast kengät eivät edes muistuta adidaksen kenkiä. Myöskään Donna Modernalla ei ole neljän raidan tunnusta, kuten hovioikeus väittää.

adidas yrittää laajentaa rekisteröimänsä kolmen raidan tavaramerkin myös neljään raitaan. Missään muualla maailmassa vastaavat jutut eivät ole menneet oikeudessa läpi, mutta pienessä Suomessa ollaan aiheesta tekemässä ennakkotapausta. Mikäli tämä tuomio käy toteen Suomessa, kuinka moni muu pienyritys vielä joutuu kärsimään?

Maailma on täynnä raitoja. Raita ei siis ole minkään yrityksen keksintö. Raidat ovat yhtä vanhoja kuin maailmamme ja niitä kuuluisi olla vapaus käyttää kuten sanojakin.

Me puolustamme suunnittelun vapautta, sekä vastustamme tavaramerkkioikeuksien laajentamista ja kilpailun rajoittamista.

UPDATE 01.08.2013 //// The Finnish Supreme court has denied the appeal (29.10.2012) in a record time on 22.11.2012. The case will proceed to the Court of Justice of the European Union, where the stripes will hopefully get freedom. We will continue to collect signatures to the petition as long as the case goes on. According to the judgement (29.08.2012) from the Court of Appeal of Helsinki, the Finnish company Donna Moderna, has to pay approximately 270 000 euros to adidas and destroy around 3 500 West Coast shoes imported from Brazil, just because they have four (4) or more stripes on them (see the pictures).

adidas has a trade mark of THREE (3) parallel and uniformly wide black stripes. On the West Coast shoes the stripes are of varying widths and directions as part of details created by the designers, instead of an identifier of any of the shoes. West Coast shoes do not even resemble adidas shoes. Neither has Donna Moderna a four stripes mark like the Court of Appeal states.

adidas is trying to extend its trade mark of three stripes also into four stripes. Nowhere else in the world have these kind of cases gone through, but in tiny Finland this is going to be a precedent case. How many more small businesses have to suffer if this judgement comes true in Finland?

The world is full of stripes. A stripe is therefore not an innovation of a company. They are as ancient as our civilization and just like words these geometrical shapes should be free to use.

We defend the freedom of design as well as oppose the extension of trade marks and limitation of competition.
